太原市小产权房问题分析研究论文设计

 I 摘 摘

 要 由于我国城乡二元体制的存在,随着经济社会的不断发展,城市化水平的不断提高。在我国现行农村集体土地所有制下不可避免的出现了小产权房。小产权房多年来受房价影响成为不少人追捧的对象,但是由于其不合规性也成为一直困扰政府的问题,尽管我国政府不断出台相关政策明令禁止小产权房的转让,但在实际交易过程中依旧很频繁,其引发的伴生问题成为政府必须要解决的严峻问题。

 小产权房的开发与销售牵涉各方利益并且错综复杂。太原是山西省的省会。由于历史和地理因素的影响,城中村分散在城市的各个区域,在这些区域,小产权房尤为突出。在太原高速发展的这些年里,小产权房趁着法律法规不完善和较为庞大的市场需求在城中村里面迅速发展,现在已经发展成一定的规模。小产权房是太原在城中村改造进程中必须要全面解决的问题,太原小产权房是否能够平稳有序的解决,关系到太原城中村改造的进程甚至关系到太原市城市化建设发展进程。本文从太原小产权房的现状入手,分析小产权房开发建设、销售、物业售后、法律监管情况,同时结合太原小产权房出现的问题及其危害,例如土地问题,耕地问题,城市规划问题,市场秩序问题等,这些小产权房所涉及的问题涉及到了社会发展的各个方面,对太原市城市的发展和国家的发展容易造成较大的影响。文章最后提出了关于解决小产权房问题的具体对策建议,从多个角度尝试提出解决问题的途径。

 II Abstract Due to the existence of urban-rural dual system, with the continuous development of economy and society, the level of urbanization continues to improve. Under the current rural collective land ownership system in China, small property houses inevitably appear. For many years, the house with small property rights has been the object of many people"s pursuit, but because of its non-compliance, it has been a problem that has been troubling the government. Although the government has constantly issued relevant policies to prohibit the transfer of the house with small property rights, it is still very frequent in the actual transaction process, and the accompanying problems caused by it have become a serious problem that the government must solve. The development and sale of small property right houses involve the interests of all parties and are complex. Taiyuan is the capital of Shanxi Province. Due to the influence of historical and geographical factors, the villages in the city are scattered in various areas of the city. In these areas, small property houses are particularly prominent. In the years of rapid development of Taiyuan, small property houses have developed rapidly in the villages in the city, taking advantage of imperfect laws and regulations and relatively large market demand, and now they have developed into a certain scale. Small property right house is a problem that must be solved comprehensively in the process of urban village transformation in Taiyuan. Whether the small property right house in Taiyuan can be solved smoothly and orderly is related to the process of urban village transformation in Taiyuan and even to the process of urbanization construction and development in Taiyuan. Starting from the current situation of small property right houses in Taiyuan, this paper analyzes the development, construction, sales, after-sales and legal supervision of small property right houses. Meanwhile, it combines the problems and harms of small property right houses in Taiyuan, such as land problems, cultivated land problems, urban planning problems, market order problems, etc. these small property right houses involve all aspects of social development The development of the original city and the development of the country are likely to cause greater impact. At the end of the paper, the author puts forward some concrete countermeasures and suggestions to solve the problem of small property right housing, and tries to put forward the ways to solve the problem from many angles.  论 1.1 选题背景与意义 1.1.1 选题背景 随着近年来我国的社会经济化水平的不断快速发展和逐步提高,工业化的发展水平和城镇化的发展水平也不断加深,城市中土地资源日益变得紧缺,对城市建设用地的需求日益增加。城市周围的部分农村人口向城市迁移,这使得一些城市出现了土地短缺。由于拆迁等原因,土地价格飙升,城市建设用地开发成本增加。随着房地产开发商商品房成本的增加,商品房的销售价格也随之上涨。然而,大量的人买不起高价位的商品房,因此小产权房以其低廉的价格进入了人们的视野,而且小产权房在使用上跟商品房没有过大差别,人们购买小产权房增多,使得小产权房的发展愈加繁荣。归根结底,大部分人们买不上商品房却被小产权房吸引,也是大多数中低收入阶层在泡沫化经济和收入限制双重作用下的被迫选择。

 普通的商品房是有房屋产权证的。然而,大多数小产权房没有国家颁发的土地使用证或预售许可证,因此不能在房管局备案。没有房产证,房价自然会低很多。小产权房通常建在村里的集体土地上,通常只在村里的集体成员之间流通,外人无权购买,就算有了产权证,也是乡或者村颁发的,是不合法的。在小产权房发展过程中问题也随之出现,因为小产权房与国家土地制度、国家城市规划、城市经济、人民生活等密切相关,是社会的焦点问题。小产权房建在集体土地上,所以小产权房的所有权也是集体化的,对于购房者而言产权缺失并且以后拆迁风险大。太原是山西省的省会。由于历史和地理因素的影响,城中村分散在城市的各个区域,在这些区域,小产权房尤为突出。在太原高速发展的这些年里,小产权房趁着法律法规不完善和较为庞大的市场需求在城中村里面迅速发展,现在已经发展成一定的规模。而且严重制约了太原市城市化的城市建设规划,不利于政府相关部门管理,冲击了当地的房地产正常秩序。

 1.1.2 选题意义 研究小产权住房问题,了解和分析我国小产权房目前的发展状况,分析发展中产生的小产权房的问题及其背后的主要原因,寻找小产权房相关问题的具体解决措施对策,对于促进我国合理妥善解决小产权房问题具有重要的指导意义。随着中国城市化进程的加快,城市在对外的扩张中不免地侵占到了城中村的部分土地,城中村也是小产权房大规模爆发的地方,引发矛盾,合理妥善解决小产权房问题。这对城市发展、城乡一体化和城市健康发展具有重要意义。同时,合理妥善解决小产权住房问题,对于在我国独特二元制土地结构下农民应该如何处置自己的住房用地有着重要的指导意义。寻找解决小产权房的有效对策,,不仅在政策理论上的确有着重要的理论意义,还有重要的历史社会性和现实意义。合
